Terms of service
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers through the LASH | CLUB online shop ( www.lash-club.com). The online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor independent professional. Entrepreneurs within the meaning of these Terms and Conditions are natural or legal persons or partnerships with legal capacity who, when entering into a legal transaction, act in the exercise of their commercial or independent professional activity.
2. Contracting parties, conclusion of contract and correction options
1. The purchase contract is concluded with Lash Club UG (limited liability) , represented by the managing director Claudia Lindow, Kirchhofsallee 41, 45239 Essen, Germany.
2. The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.
3. The customer can place products in the shopping cart without obligation and correct the entries at any time before submitting the binding order. By clicking the order button, the customer submits a binding offer.
4. Acceptance of the offer will take place within two days by:
o an express declaration of acceptance by email,
o the delivery of the goods or
o the initiation of payment processing by the selected payment service provider.
5. If no acceptance is made within the deadline, the offer shall be deemed rejected.
3. Contract language and contract text storage
1. Only German is available for the conclusion of the contract.
2. The contract text will be saved and sent to the customer via email after the order has been completed. For security reasons, the contract text is no longer publicly accessible.
4. Delivery conditions
1. Delivery is only within the EU.
2. In addition to the stated product prices, shipping costs may apply, which will be displayed during the ordering process.
3. It is not possible to collect the goods yourself.
5. Payment methods
The following payment options are available in the online shop:
1. Credit card : The invoice amount will be charged immediately after the order is confirmed.
2. PayPal : Payment is made via PayPal. A PayPal account is required for use.
3. Klarna : Payment via instant bank transfer or invoice via Klarna.
4. Google Pay : Payment is made via a Google Pay account.
5. Stripe : Processing of credit card payments, instant bank transfers, and other payment methods.
6. Retention of title
The goods remain the property of LASH | CLUB until full payment has been made.
7. Transport damage
1. If goods are delivered with obvious transport damage, the customer is asked to immediately complain to the deliverer and contact customer service.
2. Failure to lodge a complaint has no effect on statutory warranty rights.
8. Warranty and Liability
1. The statutory liability for defects applies.
2. The online shop's liability is limited to cases of gross negligence and intent. This limitation does not apply to injury to life, limb, or health.
9. Right of withdrawal
Consumers have a fourteen-day right of withdrawal.
1. Cancellation policy : Cancellations must be made by means of a clear declaration sent by email or post to LASH | CLUB . The cancellation period begins upon receipt of the goods.
2. Consequences of revocation :
o In case of an effective cancellation, all payments, including delivery costs, will be refunded.
o The customer bears the costs of return shipping.
o The goods must be returned unused and in their original packaging.
3. The right of withdrawal does not apply to sealed products which cannot be returned for hygiene reasons if the seal has been removed.
10. Data protection
All information on the processing of personal data can be found in the privacy policy .
11. Final provisions
1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
2. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
